I'm curious.
If a landlord accepts payment of rent on the due date; the due date occurs *prior* to the end of the 30/60 day notice period; and the amount of rent paid is in excess of what is due by the end of the 30/60 day notice period, the landlord will need to refund the excess rent paid, but otherwise preserves the right to pursue eviction if the tenant does not move by the end of the notice period, yes?
If a landlord accepts payment of rent on a date which falls *after* the expiration of the 30/60 day notice, and payment is in excess of what was due through the termination date, it would then reset the clock, and the landlord would again have to provide an appropriate termination notice, yes?
