Hello. I live in Georgia. This concerns a youth athletic league which is a non-profit orgainzation. The league has failed for many years to get properly organized and keep accurate records of all monetary transactions. The league is corrupt and clickish with certain members. I and many other parents have reached the threshold of tolerance with the conduct of members on the committee of the league. I am a member of this league as per stated in the by-laws of anyone who pays fees. I have requested the committee to produce any and all documents, minutes, records, etc and to comply with my request which falls under the (Official Code of Georgia Annotated, or "O.C.G.A") O.C.G.A. § 14-3-1602 (2009) § 14-3-1602. Members' right to copy and inspect records.
I have received some basic legal advice already in that since the committee failed to produce I should first go to the county judge and request assistance. I have been informed that the judge would then first ask the committee to produce. Upon receipt of whatever the committee produces, the judge will probably find also a lack of organization and accurate record keeping. I am told that the judge would then place an injunction on the committee and seize all assets and remove all committee members from their positions where then the judge may assign specific members of the community to fill the committee positions. Anyone familiar with this and the proceesses to best handle this? All suggestions are appreciated.
