I own a wheelchair buisness. These wheelchairs carry a manufacturers warranty. My question is: Are we required to service the wheelchair if the patients' insurance company has not paid us for the chair. Some insurance companies try to do anything to deny the claim until we fight for about 6 months, or more, going through review after review. In the meantime, some wheelchairs require repairs, or adjustments. What should we do? Sometimes these are custom made $10,000 chairs, sometimes they are for very disabled children, we would be crazy to reposess the chair because the likelyhood of reselling it would be minimum (because the chair is made for a specific patient). Also, frequently, the insurance company pays a PARTIAL payment. So we may be fighting for months for the balance. Does accepting partial payment bind us to servicing the warranty items? Any advice would be appreciated.
