I live in a first floor unit condo. My shower was leaking into the garage below (water following down the connecting pipe) so I had the shower replaced (by a company specializing in shower/tub replacement). The shower no longer leaks.

My shower connects directly into a pipe that passes through the concrete ceiling of the garage below. That pipe is surrounded by some filled concrete patch (as part of the garage ceiling) to hold it in place. While my shower was being replaced, some of the concrete patch fell out to the floor of the garage (causing no damage).

My HOA is asking me to pay the $100 bill for the repairs of the concrete patch.

My questions:
1) My assumption is that the HOA is responsible for repairs for the common areas, like the garage. Is this true?
2) The HOA says that since the tub replacement company caused the damage they are responsible for the cost of repairs. If the tub replacement company will not pay, then I am them responsible for paying the repairs, since I hired them. Is this true?
3)The tub replacement company inspected the damaged patch and stated that more than one of these concrete patches are defective and therefore they did not cause the damage and were not responsible. If true, it is the HOA that is responsible for the bill?
4) If I pay the bill for the patch and at some time in the near future it fails, am I responsible for fixing it, since I paid the bill?

Is there one party ultimately responsible for the bill?
