Restraining order?

Trying to find some info for a dear friend. Friend is dating a woman who has a Developmentally Delayed son. Son has PDD and Autism. Last weekend the son went ballistic, battered his mother and smacked our friend in the face. Son was arrested on DV against his mom and Battery against our friend. Battery charge was pressed by friend, the DV was done by the deputies.

The Son was Baker acted in April of this year, and has a long history of abusing his mother. Son was arrested and released on ROR. Son has no job, and the only family around is Mom.

Here's where our question comes in. Isn't there an automatic Restraining Order in a DV case? The reason we're asking is due to the fact that Mom was seen by 3 witnesses with her son in the car at a local fast food place. She lied about it at first, then claimed that the Pretrial Diversion woman had given her "visitation" with the son.

We don't want to see Mom get hurt, and would like to see Son get some help (anger management, counselling etc.)

This is an interesting case. If it was a woman seeing a RO against lover/husband then without
a doubt in my mind a temp. order will be issued, and no witnesses/evidence/facts will be needed. But being this is mother and son, and while that qualifies for an order to be issued, i guess it may depend on your local enforcement culture and like the above poster said-age of son.

The son is 18. No job, no one else in the area to help him out.

My hubby got arrested for DV with his ex wife. I don't know if it was a county thing then (in the next county over), but there was an automatic RO on him after that.

well that wasnt "automatic" as so to speak. If he was arrested then it was because the cops were called to the scene and evidence was present that there was DV. Then he had to appear before a judge then it was decided.
I was refering to "automatic" as if going to the police at any time(days even) and simply claiming DV, then a judge would most likely sign a temporary order until a hearing.

Update...

She has decided to cut us all out of her life, so it's just the two of them. There's not much we can do now, but we'll be there if she needs help. Thanks for all of the replies.
