Hello all,
I have a very specific question: Is it legal to buy (retail) an existing product which is not protected by a patent (but perhaps protected by trademark), simply repackage it, and trademark and market under your own name? It seems reasonable that there should be some sort of laws in place governing this (ie., it seems legal if the original product is available for wholesale); but if not, is there anything stopping people from buying retail and marketing the same product under one's own brand?) In other words, if the new person intends to distribute the existing product under his or her own brand, can the new person simply bypass the manufacturing of the product by purchasing the original product (already manufactured) itself from the original brand?
