I live in NYC, I'm the lower property that shares a retaining wall. It is on our property line. The wall is starting to lean in towards my pool and bent my fence. I had a contractor look at it and he said in his experience with the city the higher ground is responsible.

I contacted the owner of the house months ago and he has been delaying. I texted him yesterday and he said he would have his landscaper remove the debris.between the wall and my fence. But i send him pictures of the wall starting to cave towards my property.

All i want is to have him shared the cost, unless its his responsibility.

I haven't been able to find a lawyer to call me back on this issue either.

So call your city to learn if they have a ordinance that addresses this and if they do then invite them out?
