A year and a half ago my wife reduced her hours at work from 40 hours to 35.
As a result of this, her employer informed her she was no longer elgible for short term disability pay. That was understandable since she technically was no longer a full time employee.

The problem is that her employer continues to deduct $16.40 from her paycheck every week for short term disability. She has asked the office manager who is responsible for this many, many, many times about stopping the deduction. The manager's response is always the same, "I'll take care of it".

The fact that this has been going on for so long is ridiculous. Since it has been going on this long, I would'nt mind sticking it to them a little bit. So my question it this: If my wife were to have an instance where she would need to use short term disability, like say, have a baby in three months, would she be entitled to it? As soon as she has the baby can she put in a claim? After all, she has been paying for it.

I don't see how this question is related to workman's comp. Having a baby I would think falls under FMLA.. You don't pay for FMLA or workman's comp..
