I recently acquired the interest in a property from a Heir-at-Law, whose parents lost their property at a Tax Sale 45 years ago, there were no bidders at the time so the Town took in the property. I went to the Town Hall recorded a Affidavit of Family Facts and a Quit-Claim Deed and then proceeded to the Tax Collector/ Finance Director to redeem the property, the Town would not give me my right and claimed they had clear title based on the Marketable Title Act in which a forty year period is required to make this claim,so I decided to do some investigating on this Tax Sale in 1960 and found that proper notice was not given to the owner based on the fact that the address the Town used to give notice of this Tax Sale was totally incorrect. So I have two questions : (1) based on the Town not properly notifying the owner wouldn't that make the Tax Sale void, and (2) does the Marketable Title Act Supersede The Right of Redemption, the law seems conflicting! Thank You to anyone who can shed some light on this.
