Rights for vehicle damage from tow truck

What is the name of your state (only U.S. law)? Texas
I'm not sure that this is the right area-I know that it is a civil manner. My fiance's car was damaged during a routine tow. Do we have any rights regarding holding the tow company liable for the damages or are we out of luck and on our own for the repairs?

Of course the damage was documented before the vehicle was taken from the towing company's possession, wasn't it?
