A very close family friend,who was grew up with my husband passed away and left my husband Power of Attorney over his financial affairs and he left his roommate POA of his medicals affairs. Our friend has always told my husband that whatever he had he wanted my husband to have when he passed away. Of course with no will I suspect that is irrelevant.
Our friend had no assets to speak of only a motorcycle which he still owed a large balance on that we had turned in to the dealership. He does own a car that we would like to ship to California and he may or may not have a balance on it that we are willing to pay. My question is this: without a will does his estate (car) need to go into probate or can we have the title changed over to our name? Does the roommate have any right to the car? He also has a son, who he had no relationship with that is ready to grab whatever he can.
Since no family or friends stepped up to pay for the cremation we handled the costs and would like to car to help reimburse the costs.
Any advice would be greatly appreciated. We are California residents and our friend is a resident of Hawaii.
