Two of my employees (non-union) walked out of the job after complaining about the temperature in the factory. Temperature within operating standards which have been in effect prior to either employee being employed. Upon their return to work the next day, the employees were notified that they were being terminated for the walk-off. Employees are now threatening to sue alleging their discharge represented unlawful discrimination against their rights to engage in concerted and protected activity under Section 7 of the LMRA. They are requesting full back pay and restoration of lost privileges.

Was their discharge unlawful under the LMRA? Do they have a case? Your timely response is greatly appreciated.

They were wrong to walk off the job. The act they are referring to has absolutely nothing to do with thme walking off the job. I'm a union steward and always try to take the employees' side but they were wrong. They should have asked for their safety rep(if there is one where you live). They also could have requested to go to medical. They got some bad advice to think they could just walk off the line.
