Roommate not holding up her end of the deal

Last October I rented a “rent to own” house with a roommate. Both of our names appear on the lease. My roommate has been laid off and not actively looking for employment. She gives me 200.00 out of each of her unemployment checks but I’m left to cover her remainder share. I’m forced to live check to check and haven’t been able to save and I’m living beyond my means. I do not wish to renew the lease in October. Can I be penalized if I tell me landlord I will give him my half of the rent on time until the lease is up and he must take up receiving the other half with my roommate? Is there some legal responsibility that my roommate is obligated to?

Effectively, you made a partnership with your roomate. You are both liable. If you're willing to accept her $200, you're not being forced to live check to check. You're just in a bad partnership. Problem with telling your partner they need to come up with more $$ is that they just might go MIA & leave you with 100% of the rent.

The landlord doesn't have 2 tenants each responsible for paying half, the landlord has 2 people who are both responsible to see that 100% of the rent is paid.

You can certainly choose not to renew your lease come October.

I say move and leave the now "magically transgendered lazy babymaking boyfriend" (er "girl") on the hook to pay his/her own bills. Try and negotiate a lease termination with your LL, and find a smaller, cheaper place to live with your kids. And for the love of pete, file a petition for child support yourself! If the LL insists on suing you BOTH for the remaining months on your lease, turn around and sue the "girl" in Small Claims court for 1/2, and get a judgment that will stay with him/her for the next 10 years or so.

BTW, when child support is ordered, it is usually determined by the earning capability of the individual, and not just on what their current level of income is. Time to put away the videogames and make him/her get a job to support ALL his kids. When he doesn't pay, the judge can put him in jail for you as a deadbeat dad.

And seriously, we can't keep answering your posts with accurate info if you keep changing the story. Get your story straight before you reply or post again.
