What is the name of your state? What is the name of your state? NY, Second Thread not sure which section to write in for help. My son is divorced since 4/03/06, a verbal agreement between the two of them (no court order) she could remain in the house until it was sold. My son works 2 jobs, supporting the house, mortgage, utilities, food, car payments (both) insurance including child support. She has not worked in the four yrs of marriage and still doesn't. She has not looked for any other arrangement for living, she thinks the house is worth alot of money. The verbal agreement was, she can have any and all profit after the mortgage is pd and any bills outstanding that occurred during the marriage. My son pd someone to come in the house in June 06 to clean top to bottom, paint etc. She returned from 1 month vacation and the house is upside down, she refuses to clean, no dishes are done, laundry all over, refuses to let dog out or clean up after the animal, when my son somes home from work 1AM he lets animal out. He has tended to outside but there too she now throws the garbage out side of house. Problem is both their names are on mortgage and deed, he can't throw her out and she is not looking to get out, can he sue her in civil court for the damages or sabotaging for sale of home.
