I am a U.S. Citizen, recently married a German citizen. Although his passport is valid, his I-94 has expired. We have recently filed for I-30 and are taking all appropriate steps.
My question is, Is there a risk,if any, going on our honeymoon cruise to the U.S. Virgin Islands and our paperwork has not gone through by departure. We depart from Florida and return same. Clearly,we will both have our passports, marriage certificate etc.along with us.
If the I-94 has not gone through prior to our leaving are we at risk for immigration problems as his I-94 is currently expired, again his passport is valid. Although we will not be leaving U.S. Jurisdiction, I understand that all non u.s. citizens will be subjected to an immigration check.
Thank you for your help and patience, this is all new information to me!
