I am a subscriber to DIRECTV and I had it installed about 2 years ago. Now my co-op association is telling dish subscribers in my community that they need to take them down per FCC rules. My dish is placed on the roof of my building, I own my co-op but the roof is owned by the association. They sent a letter out a few months ago stating that new owners are no longer allowed to put them up and never mentioned that they were looking into demanding that people whom already have them take them down. There reasoning behind there new rule is that the dish when it is removed leaves damage to that specific area on the roof. When we asked before we installed our dish whether or not we needed to get written approval from the Board of Directors we were told no we didn't need any kind of approval. I can understand the association no longer allowing new owners from getting satellite dishes because of the damage they cause to the spot where they are to be installed but I do not think people who had them installed without needing approval should be forced to take them down because the association did not think to investigate the pros and cons to installation before they gave us the verbal approval to have them. I would be more then happy to pay for the cost of repairing the damages to the roof when we move and have it removed but I do not think that they have the right to have people take them down after allowing them to have them installed. I would be more then happy to have the dish installed on another area of the property meaning my window ledge but association rules prohibit anything from being put there. Can I insist that they make a compromise with us and let us put them there? Can they really make us take it down once we've put it up since it does not pose a safety problem or is not installed on historic property? Or can I sue them and have them pay the remaining money that I owe DIRECTV because I have a 4 year contract with them that I need to pay whether I cancel my contract or not? I need to find out if there is something I can do or something they need to do for people who were allowed to have them installed.Does a grandfather clause apply to this problem? I would appreciate any comments or suggestions....
