What is the name of your state? New York

I have a daughter in elementary school and I want to know if someone can call the school and get info such as if shes in school or not without my permission. The person calling is not a cop, social worker or any kind of authority. The office has spoke to this person and has released info numerous times. Can they do this?

Who is the person calling to get the information?

OK, heres the story. I recently injured my foot to where I have to use crutches and even with the crutches it's unbearable to walk a little distance, not even to get down or back up my flight of stairs. I'm living in an apt where this agency helps pay some of my rent and this lady is telling me that I need to find a way to get my daughter to school. I have no family to help and dont know many ppl in this area. I refuse to put a 6 yr old girl in a taxi alone either. I spoke to the school social worker and she understands the situation and she's helping when she can to come get my daughter and bring her home. Everyday for the past week I been told that this woman is calling there to find out if my daughter is there or not and when she's told she not there the agency calls me. I dont like the fact my daughter has been missing a little time in school either but I think for childrens saftey they should know who they are releasing information too reguarding other ppl's kids.

Well we are working on the 20 question method.

What agency?

I can think of a few agencies that would have the right to do what you have stated. It is generally preceeded by some action they took. By your last post it almost sounds like YOU don't know when your daughter is missing school.

If it is a private agency, they probably do not have the right to ask the info you are concerned with. Many public agencies could do this without a court order.

Have you called the school and told them you absolutely do not want them to give out this info? Chances are they will tell you why the mystery agency is allowed to do this.

It is a private agency, Shelter Plus Care, and I do know how much time my kid has missed, lol. I did ask the school social worker why is ANY info being released and if they can do it. All she said and I'll quote " I don't know and I don't know what their problem is upstairs" meaning the school office. I know with a few agencies I'm involved with they all need release form w/ my signature to talk to each other about me so I would think the same would go for this situation. My problem is that anyone can call there and how would the school know they are from where they say they are.

You should contact the school about busing and/or car pools. Where is the child's father? Can he not take her to school?

Being the fact that it is a private agency with apparently no legal standing, I would send a letter CRRR to the school super, the school principal, the person making the calls and the farthest upstream official in the agency.

Make it a non-threatening letter addressed to the school superintendent with copies to the others. Let them know you are aware of what is happening and unless they have some legal justification to continue that it be discontinued immediately.

As far as legal ramifications of what they are doing, I don't know but if all is true in your post, I do understand the concern, especially given today's atmosphere.
