I live in Oregonand recieved a ticket for going to fast in a school zone. I was only going 5 above the speed limit if the school zone was not there. It was 9:00 o'clock and there were no children around and the signs say that the speed is 20 when children are present. Can I fight this?

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

I am not sure what your speed was. But okay, if you feel you would have been okay if the kids were not present, then fight the ticket based on the following:

The low speed limit is based on the intent to keep kids safe during school hours they go to and from school. All children are in school by 9AM and thus, the low school zone speed limit does not apply but rather the higher speed does.

Hope this helps.
