I recieved a seat belt ticket in Texas. My truck is a 3/4 ton with a GVWR of 8800#. In Texas, you do not have to wear a seat belt in a one ton, but I was told by a friend in the same situation, that if the truck has a GVWR of over 8600#, then it is considered a one ton, and you do not have to wear one. He got out of his ticket for this reason, but he did not get it in the same town. I called the very rude judge in the town where I got mine, and she told me that it was not true. Please help me if you can, before I pay the ticket.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

According to what is below, you need to find the definition for "light truck"
http://www.dot.state.tx.us/vtrinfo/vtrinfo.htm

All front-seat occupants of cars and light trucks must wear auto safety belts.

Texas law prohibits the consumption of any kind of alcoholic beverage by the driver of any vehicle.
All children under 15 must be properly secured in a safety belt or car safety seat, whether they're sitting in the front seat or the back. Children two and under must ride in safety seats. Children ages two and three may ride either in safety seats or buckled up with safety belts.
