Seeking divorce form missing US husband

I am British & married US husband in Florida 1988. We split after 9 months and I returned to UK. Ive searched the internet and placed notices on some bulletin boards on the net. I have no idea of his present whereabouts or if hes even still alive. I now want a divorce and need to know wether it would be wiser to hire US Attourney than British Solicitor. Which will produce cheapest and quickest result?

The problem is that you can not file in the US as you do not furfill the residency requirement of 49 of the states.. and the final one you would have to physically be in to file...

So your best course of action is to talk to a UK solicitor and see if there will be able problems filing in the UK.

To file a divorce, or many other petitions in the US you have to be a resident of that state. This stops Fred from VA filing in NC as the laws are better. To file a petition in VA for divorce you need to be a resident there for at least 6 months.

Therefore, if you have no one in the US with residency, then you can not file for divorce. If someone does reside in the state and files against you, THEN you can get an attorney to work on your behalf and YOU do not need to be anywhere near the US.

So if I find my husband myself and get HIM to file divorce it would be much easier prehaps?

Yes. Do you have any idea where is might be ? What about his Social Security number ?

I have an old driving license of his with social security number on. How can I use this to trace him. Can it be done on the web or would a lawyer need to do that?

If you have a SSN then you can generally trace anyone down as it used for everything. This is totally unlike the UK NI number which is only used for taxes & pay.

I suggest you search the internet first. I am sure if you look you will find places that can give you the information you need. Failing that, ask a US based attorney. Find some with websites and email them on the pretence of waiting to retain them. Most will reply with some basic info etc..
