I spent $460 on a modded Wii off of Ioffer.com. The seller never told me that he did not have the modding chip in stock and needed to order it. He did accept the paypal payment

This seller got no negative ratings and very high feedback on ioffer which is similar to ebay. My account was suspended why you ask?? because I was accused of slandering someone calling his low priced Nokia N96 a 'Cheap Chinese Fake' and refusing to pay. No I have no recourse with Ioffer

I filed a claim with Paypal & canceled it after assurance it was ready to ship. Now I get no response. It has been over 2 weeks.

Since my claim is closed with Paypal, can I dispute with AMEX and send AMEX all the correspondence with his promise (and excuses) to ship.

As I told him in the last email, maybe on the West coast (he is in CA), people are more laid back, trusting and gulliable, but in NYC we can smell a scam a mile away.

I have to say this was the first (and last) time I will ever use one of these auction sites. So are essentially at the sellers mercy if he wants to ship the item or the item is the item you think you are buying. As the saying goes ... fool me once...

I haven't had an issue like this on ebay since 1999. Paypal is a great resource for buyers, despite what you say it is very buyer-biased, so much so that some sellers refuse to use it. You should have kept the claim open until you received the item, that way if it never came you would get a refund.

If the modded console is to contain a modified bios derived from the original bios that allows the console to play unsigned code, the item you bought is illegal. I'm not going to get on a soapbox about piracy, but that could impede your legal options here.

Thank you for calling us Californians gullible and unable to detect scams. Good to know I wasn't really an e-mail security engineer until my job was shipped off to Russia. Or maybe it was shipped off to e-mail-scam-central because I can't detect a scam because I'm a Californian.

You can dispute it with Amex if you'd like. Or you can trust this guy's perfect feedback that you will get the item you paid for.
