Seller Disclosure Ommission

What is the name of your state? Ohio

I purchased a duplex(and live in one side) in march of 2004. There were some things disclosed on the disclosure form, but nothing I thought was serious enough to be of concern.

About 9 months later,(jan) after tons and tons of rain in the ohio valley, I noticed I had about 3 inches of water in all my vent ducts. The house is built on a slab and the ductwork is run through the slab. Then my tenant called to complain about the water that was sloshing around in her vents. During our discussion, she mentioned that it had been quite some time since this had happened before. Upon further questioning, she confirmed it had happened before while the person who sold it to me was the owner, and she informed him of the problem, making him aware.

I'm a new homeowner (and an engineer), I'm aware that concrete is porous and that with so much rain, you are bound to get moisture & some water. I'm trying to find out if the water I had was indicative of a more serious problem that should have been disclosed on the sellers form. And if it is, what legal options are available to me? Can I sue the guy because the item not disclosed adversely effects the value/resale of the duplex? Clearly, I would legally have to state this problem if I were to ever sell a house.

Anyone have any experience with water? and dealing with ommission on the property disclosure forms?
