My sister made an offer to purchase a mobilehome in April, 2005. She was pre-approved for financing and the seller accepted her offer. To this point my sister has met every requirement of the contract.
We are now 35 days into a 45 day escrow and when the seller went to the title company to sign the paperwork, the escrow officer hadn't arrived yet so another employee went over the forms with them. Unfortunately, the person at the escrow company was incompetent and told the sellers that a "power of attorney" form that my sisters lender needed in order to obtain payoff information from the seller's mortgage company was actually a form making them responsible for the loan if my sister were to default. This is entirely erroneous information and now the seller has refused to sign the documents. My sister has essentially been told by the title company that she needs to find a new lender (and start all over again) that is "in state" and they have advised the seller not to sign the documents.
My sister has paid in advance for a moving service to move her in 10 days and was required by the mobilehome park to pay 6 months space rent in advance. If this thing doesn't close on time, she's out quite a bit of money. Any advice?
