I'm not sure if this is the right forum, but it seems to be the closest match. My car is not a declared lemon or lemon buyback...but my car used to have some problems with stalling, which have been fixed and resolved by the dealership and manufacturer. I was advised by a lawyer that I should disclose this to the dealership when I do a trade-in and have them sign off on a document stating that I disclosed this to them and that I'm not at fault if the issue comes back in the future and someone gets injured/dies in an accident as a result of it. Needless to say, most dealerships aren't enthused and won't sign the paper. They all say that as soon as you sell it to them, you are immediately absolved from any future issues. Is this true? So if I sell this car to them and something happens in the future related to this stalling issue, I really can't be sued? I don't trust them because they're salespeople and will do anything to get you to sign the papers.

If the problems have been fixed, there is NO obligation to disclose to anyone. And even less if you trade in through the dealer as they have access to all the warranty records done on your vehicle.

Yes.

So if I sell this car to them and something happens in the future related to this stalling issue, I really can't be sued?
Based on your description of the repaired problems, yes.
