According to Illinois law concerning the resale of tickets, tickets cannot be sold for more than face value (except by a ticket broker licensed by the state of Illinois). However, other states such as Indiana do not have any ticket resale restrictions. My question is, is it illegal for me, who lives in Illinois, to sell tickets for any amount above face value if the event is located in Indiana (i.e. Indianapolis Colts tickets)? If it's legal, does it matter where the buyer is located (Illinois of Indiana). Thank you for your help.

You need to learn what the term "point of sale" means. The place where the exchange of funds for product is the point of sale and the laws of that place is what take priority. In your case, the laws of Illinois apply. Unless Indiana has changed it's laws, Indiana has some fairly strict laws concerning ticket scalping too. I attended the Brickyard 400 at Indy 5 years ago. It was on the news that there was going to be special enforcement at the track to prevent illegal ticket scalping. I saw very few folks selling tickets outside the track and those that were selling were asking face value. The police presence was very noticable too.

Thanks for your help. I've looked into this a bit more, especially regarding the sales of tickets via eBay. The situation here is if I (who lives in Illinois) sells tickets to the Indianapolis Colts game (in Indianapolis) for above face value. According to eBay:

Because you do not live in the same state as the event, these tickets can be resold without restriction.

If I'm reading this correct, I'm protected under this situation? Where exactly would be the "point of sale?" Thanks for your help.
