i never cheated on my husband in the 18 years we were married. we separated in oct 2001 and i started dating and fell in love with a man that i have been seeing since dec. my husband is a very controlling man and said he was going to force me back. so he is trying to take my boys away by saying he will sue me for adultry. how can it be adultry if it was after we separated. plus i have an agreement from him stating that this man can live with me.

You didn't ask a question. However, I will tell you the following concering your situation: You have no legal seperation agreement. If there was one it probably would be worded "both parties agree to live as if single" . Even with that, living with a man you are not married to in front of children probably is enough for him to gain custody. Thats even if you DID have have custody, which right now, you do NOT have custody of the children. He'll probably see a lawyer who will tell him to go get his kids and will file the legal seperation papers with him having custody, child support and yes, spousal maintenance (judges in VA love to give spousal maintenance if adultry is proved) from you. Will the judge find your behavior immoral enough to give him permenant custody? I dunno, no one has a crystal ball (that really works). Your living in dangerous situation.
