Perusing previous posts I read that a couple seeking divorce after 16yrs.(?) of separation potentially absolves one spouse of the others marital assets. If I read the reply correctly it said after 1 year of separation there is a loss of claim, so to speak.

Is this true? Would it have to be a legal separation via the courts, or is a physical separation sufficent? (living in 2 diff. dwellings.)
