Served w/divorce after being final 5 years ?

California - I have been legally divorced for 5 years as of February . To my shock , I was served this week by my X with divorce papers he has filed ! He got served when I filed and the entry of judgement was sent out to us both , he knows it is final - yet he is in denial or something - and went to the trouble of filing and asking for visitation rights to MY SON > NOT HIS ! What in the He-- should I do ?

File a response to his suit. Include with your response a copy of your divorce papers from 5 years ago, as well as a copy of your son't birth certificate showing that he is not the child's father. His case will get dismissed.

Personally, I would recommend having an attorney handle this for you, and have the attorney ask that he be responsible for paying your legal fees for this totally frivolous suit.

This is what I thought I should do - just go back to the attorney that handled everything for me in 2000 . And I did that Friday after work - but he was out of the office so I left a message for him . I'll be calling first thing Monday morning for sure .
