Hello,

Just wondering if anyone with any legal advice knows how to set up an offer for settlement on arrears.

The children are well into there 30's now and my X is retired and out traveling around etc. During the children growing up I helped out as I could and have a good relationship with them. All is fine on the home front - the only problem is that the states got involved years ago when my X was on assistance for a couple years - I would say 25 years ago for a couple years. Since then that debt has been paid back but of course the state keep their grips on the child support arrears.

My X and myself have discussed a mutual settlement amount - she is perfectly happy with this. But I guess how does one set this up? My X does not know how and with her traveling around all over she really does not have a address. She contacted her state she lived in Oregon where the support order orginated from and they told her I have to go through my state Idaho.

Well my state will not give me any information on anything just says pay, pay , pay.

What business is it of theres (Idaho) if my X is fine with accepting a lump settlement, the children are fine and everyone is fine - why should it matter to them? The payments go to my X anyways for ther past support (which I helped them in many ways over and above just the cash monetary aspects).

Again my X is fine in just receving a lump settlement - but I think this has to go through the courts someway.

No bashing please - no-one knows each others lives and this is a mutual agreement between myself and my X - there is no disagreement on this matter. Just want the states to leave it to us.

Any suggestions would be appreciated.

A: The government (me and all the other taxpayers) paid out a certain amount. We want it back.

Done that long time ago!

Well - I have paid amount has been paid back many, many, many, many years ago (back in the 1980's I believe) so that is paid in full. None of this arrearage amount has to do with owing any back payments to the state when she was on assistance. So you, me and all the other taxpayers has been paid back in full! This is strickly between my X and myself.

So that Quote does not apply to this situation.

Any one with some un-bias helpful information?

So you are saying that is someone is asking for un-bias, unjudgemental advice then this free advice forum is not where one should post at?

I though this was for everyone to post - I was hesitant to post as I seen how people get bashed so bad in here.

But I thougth I would give the benifit of the doubt and post just incase there was someone in here that acutually knew what documents to fill out or steps to take.

So if anyone knows which steps to take please respond otherwise please respond otherwise no response is needed.

At least if you PRETENDED to ATTEMPT to locate information yourself, instead of being defensive ABOUT INFORMATION THAT YOU PROVIDED, you might get better responses.

How about: I saw the follow modification form on the internet. Do you think that I could use it for my arrearages situation? Both CP/NCP and I agree to to...(add whatever).

Will this form work for this situation?

Sorry I looked on the internet quite a bit before I posted I guess nothigng looked like what I was looking for.

Talking on the phone to attorney now and I think I have what I need.

I did see both the links you listed before I even posted and neither one pertain to what I am seeking.

This is not a child support order as it is to old the children have been emacipated to long already so there is nothing to modify per say as far as child support.

This is considered a judgement payable to my X and not no longer what one would call a child support order.

Again thanks for trying to help.

I did find out though all one has to do is send a cerfified letter to the state that is handling the arrears and request for the documentation on "settlement of arrears to NC parent" to be sent to you so one can fill it out and send back to them. They then have to contact the CP and see if they accept the offer - if they do they sign the agreement and then you request to have it submitted before a court to have it finalized.

Hopefully this information will help someone else out that may be looking to do the same thing.
