I was in an accident a few weeks ago, other party 100 percent at fault, her insurance company says they are sending me a check for my totaled car, and I told her I'm still under a docters care, she said thats a seperate claim, and that after my treatments done they will settle that part, I dont think my injury is very serious, but you never know, if I cash the check sent to me for my totaled car, does that wipe out any claim for medical? she says no, but she will say what I want to hear.

"She's" correct. Your property damage settlement has no affect on your pending personal injury claim.

Property damage has nothing to do with a bodily injury claim. Even if they accept fault on the PD, they can defend on the bodliy injury without any regard for a prior settlement.. it is irrelevant
