Voluntary Witness Statement from Elizabeth Re: Sexual Abuse of my daughters by their father, Danny
I declare under penalty of perjury the foregoing is true:
I have known Danny since 1980. We have two children together: Hannah, 13 years old, and Jesse, 10. Danny and I were never married and have been separated for the past 9 years, during which time his visits with our daughters have varied from once a day to only once per month.
I recently discovered that Danny James has been sexually abusing both of our daughters. I immediately sought advise from a San Juan County social worker who counsels abused teens. I then removed my children from immediate danger. (This was Thanksgiving Day) On Friday, the day after Thanksgiving, I reported this to Deputy Scott Brennon of the San Juan County Sheriffs Office, and was told to come back on Monday to meet with ‘Detective Johnson’ who would then be back from the Holiday. I returned on Monday at which time Detective Johnson interviewed the children individually.
After these interviews, Detective Johnson stated to me that this “is an isolated incident due to a breakdown of morals caused by the use of drugs and alcohol”. I adamantly disagree.
Detective Johnson and a Child Protective Services (CPS) representative have informed both of my daughters after interviewing them that “It looks like Danny James is going to walk on this one” stating further that this is due to a “lack of information”. I was, however, informed by the witness (also present during the interviews) within hours after the interviews, that both of my daughters had in fact individually spoken of numerous incidents of sexual abuse by their father, none of which were the same but all of which involved their father.
During the interviews, both girls spoke of past instances when they had stayed with their father in a ‘travel trailer’ where they remembered going to bed clothed, and then woke up naked and cold later in the night. Jesse described feeling ‘like throwing up’ because ‘dad was doing something really bad and there was nothing we could do about it”.
Jesse told me Detective Johnson explained the difference between ‘rape’ and ‘molestation’ to her during the interview. He told her “the law clearly states if any object touches the outer lips of the vagina it is molestation, and if any object enters the second lips of the vagina, it is rape.” He then told her she “was raped in the slightest degree”.
Danny had gotten into a couple of car accidents, one with our daughters in the vehicle with him. After I found out he had been drinking I refused to allow him to take the girls driving again. This was about 5 years ago. Hannah has shown extraordinary anger (almost hatred) toward him ever since. She would cry at the sight of him and leave the house screaming at him. I have recently been made aware that he was in the process of sexually abusing her while driving down the road that night, which caused the accident. Her extreme anger toward him now makes sense to me where as I had questioned it previously.
Hannah also described this incident during her interview with Detective Johnson.
In the past, Hannah has told me that we needed to ‘keep Jesse away from dad’. She said that ‘Jesse would see what a bad person her dad is’, and that ‘he would break her heart like he broke mine’. I would ask her what she meant but she would never elaborate.
Hannah was sent home from school twice last year because she had been cutting herself on her arm with a pin. I immediately sought counseling for her and me. Shortly thereafter, Hannah refused to continue with counseling. Unfortunately, the school, the counselors, nor I had knowledge of the sexual abuse at this time.
Over the years, Danny has been violent on numerous occasions. One example of this behavior occurred when we lived in Centralia, WA. Danny was arrested for kicking down the door of my home and subsequently arrested. The court issued a no contact order for one year, and despite that order, Danny called me several times from jail. Shortly after his release the police arrested him again for breaking into my home. I believe Danny feels as though he is ‘above the law’ as he has stated this to me many times.
Danny is currently homeless and does not have steady employment. He is, and always has been, unwilling to provide a suitable home - for even himself.
There has never been a court order for child support, and he has never paid child support to help provide for our children.
Danny has very recently been heard telling various people in the community that he “just can’t believe the **** my girls are stirring about me” in regards to us going to the authorities to report his sexual abuse of them.
I have filed a no-contact order. I am seeking counseling for my children as well as myself. I am counting on the authorities to take the appropriate and necessary actions required. I need help protecting my daughters from being sexually assaulted by their father, ever again, and help in pursuing justice for the horrible crimes he has already committed against them.
We fear for our safety and well-being.

The Prosecuting attorney told me that they didn't have enough evidence and weren't going to arrest Danny despite code RCW26.44.130

Detective Johnson wanted to interview girls alone and asked inappropriate questions. Skipped Truth/Lie ground rule
didn't investigate or interview mother, disclosure witness, or friends
Child protective services
should have been at the interview but wasn't.
Victims Services
The Protcol specific to this county for Prosecution of child sexual abuse
I talked to two people in victims services the only thing I got from them after demanding for it 4 times was a voicemail saying they sent me the protocol that was incomplete
was never given victims rights info

Led me around like a drone from agency to agency but when i asked them to write a statement about what they remember. she didn't see what purpose that would serve.
Since that time I have been strong armed into placing one of my daughters in foster care..
