My niece is in a custody battle with her ex-husband. The little boy is 3. Her ex was arrested and indicted by the grand jury of North Carolina for sexually molesting his 15 year old daughter (who was 8 at the time of the abuse). He is out on bond. Her question is, can he leave the state while he is out on bond? She has a restraining order against him until the case is over, but I know for a fact he has left NC at least once (I saw him myself). Is that legal and what can we do?

probaly not without court approval.

probaly not without permission from the court. hes also probaly not allowed any contact with children under 18 without supervision. if he leaves the state without permission, he can have his bond revoked, and be jailed.

Leaving the state is a HUGE no-no....it definitely could get his bond revoked.
You could report it to the authorities...however you may not be considered to be credible because of the situation.

I suspect that your niece isn't going to have to worry about the custody battle any longer. :eek:
