What is the name of your state (only U.S. law)? California

I opened a factory sealed package of Gerber Puffs baby food and inside, directly in the center standing up was a used Sharpie marker. I didn't feed any of it to my baby. I called the company and they sent me a postage paid shipping label to me to send it back to them so they can "further investigate" Advice? :confused:

Send it to them and let them investigate.

The only recourse you have is for the value of the food. You (nor your baby) suffered any injuries or damages. You can't sue for what could happen. You can only sue for what did happen.

You'll probably get a coupon for some free stuff.

So let them investigate. If this really did happen then they may be able to find out why and prevent future occurrences.

And no, you have not won the lawsuit lottery.
