I am in Arizona. A couple years ago my daughter came to me and asked if my best friend who I called sister could adopt her. Considering we have all lived in the same house for many years I did not see the big deal of who signed the papers for her so I agreed. Her lawyer had me sign a paper and told me that if the adoption did not go through that my daughter would revert back to me automatically. My friend/sister was given legal guardiandhip over my daughter till the adoption was final. A couple years later and there has been no progress in the adoption. I have continued to do everything for my daughter. I cook for her, I get her up for school, I listen to her problems when she needs it, and I take her to her Dr. apointments when she has them. We have continued to live in the same house. I just dont sign her school papers. She is still on my AHCCSS and TANF case, She sleeps with her silbings in my room as well. Here is the problem. My friend and her no longer get along. She no longer wants to be adopted and my friend wants to turn her over to foster care if I cannot get custody back of her. She told me to do what I have to to get her back and she wont fight it, but i have no clue how to even begin. I am on a fixed income (SSI) so hiring a Lawyer is not in my reach. I have tried calling Legal Aid but get no call back. Can someone please just tell me what I need to file to begin the process. right now the adoption is not final and she only has guardianship. What can I do to save my daughter from being put in fostercare?

The only thing that should be necessary is to file a motion to vacate the guardianship. In fact, if you and your friend file a stipulated agreement to end the guardianship that should take care of it.
