Hello Forum Members,

Here's my problem! Last night, a woman assaulted me in regards to my question as far as who had scratched my Mercedes-Benz(Keyed), the following month, at a nightclub (I had info that she was the culprit)! Well**************.... tonight, I had asked her her if she had done it.

Well**************..... she went bullistic, and said that she didn't do it.! She was DRUNK & then Kicked a MAJOR dent in my rear quarter panel on my car! Shen then confronted me, slapped me, then "straight armed me in the face!(Threw a punch)!" I then "straight
armed her, & she went to the ground". She then got up(off the gound), & called me numerous names! I have witnesses! I was told by patrons' that she has a history of violence, against both, women & men !!!!

Forum Members(especially Women)! I have never "hit" a woman in my life! This was SELF DEFENSE!

What do you recommend ??

I plan on retaining a criminal lawyer, tomorrow, morning!

Hopefully they were BOTH arrested. IF she truly did throw a punch, she's just as criminally culpable as he.

I don't know if I agree with you on this one...If she was attacking him and he hit her to protect himself, than I don't think he should be arrested...I guess it just depends how it played out...

Thanks for the info. No I wasn't arrested. After the incident, I got in my car & drove home. I am retaining a lawyer being that I'm not sure if the police were called, but if so, and a police report was taken, I want to be protected.

Should I contact the police department, this morning, before I retain a lawyer - to see if I am a "wanted man" ??

It is possible that you would both face charges. Depending on the circumstances, either one of you might be considered the primary aggressor and be the only one charged.

If this is a woman with whom you have had a dating relationship, this could be a domestic violence issue and it could be bad if she reported it to the police. On the other hand, if this is NOT a woman with whom you have had a dating relationship, then the DA is likely to see this as another drunken bar fight and either toss battery or fighting in public charges at both of you, or, drop the matter entirely. The DA in my county tends to drop most bar fights as "that is what drunks do."

If you struck her out of anger and not in an effort to cease her active attack, then the self defense argument may not fly.

Do you know if she called the police? Chances are that the police will contact you before they forward anything to the DA as they are going to want to get your side of the story as well as the story from any witnesses.

You may be paying a non-refundable retainer on an attorney for nothing at all.

Thanks, Carl !! I have only seen this woman at the bar & really, do not know her. I had to "straight arm" her for my own protection, not out of anger. The damage she did to my vehicle is pretty major. Thanks.

Why then if she was so relentless , allow you to get in your car and just drive off .

You make no sense , unless you were also intoxicated , and were afraid if the Law was called , they'd see exactly that , and arrest both of you .

This is a club brawl ... Because you went there looking to find an answer from her .

Thanks for your input. She was relentless, so I had to give her a stiff "straight arm" to stop her attack. She then went down to the ground. This allowed me to enter my vehicle. I have never, never, ever, hit a female. This lady, by throwing punches & damaging my vehicle**************... got what she deserved.
