What is the name of your state? Missouri. I was sued by a credit card company. I just got a letter from the attorney that states:

Because of your failure to make the required payments on the judgment that was entered against you, we have recieved instructions to obtain the assistance of the Sheriff in enforcing the judgment. Please make this action unnecessary by making a payment to our office within the next six days, and regular payments each month thereafter.

Is this a scare tactic or what.

Across the bottom of the letter it states:

This communication is from a debt collector attempting to collect a debt, and any information obtained will be used for that purpose.

I own nothing but my clothes, and a bed. I am on disability, and live on a limited budget.

If a judgement is won against you (and it will be) then the sheriff will become involved, but only to the extent allowed by law. That would be to serve notice, conduct a sheriff's sale or other statutory requirements.

They WILL NOT be involved in debt collection.

Another thing to is that the payment plan could very well have been court ordered. If you have defaulted on such a payment arrangement, then you may have been found to be in contempt of court, which is the likely reason they sheriff is getting invovled.

Its NOT a scare tactic. If you don't make some arrangments to start paying on that judgment, the Sheriff will be showing up at your door to sieze your stuff to sell. If you have not claimed your exemptions you'd better do it ASAP.

If you don't want the Sheriff showing up with a truck, you'd better DO something.
