I was pulled over last night (my 21st birthday) for drunk driving. On the scene I blew a .63 but when I got to the station I blew a .46. Obviously the first was illegal the second was not. The office who brought me in said the first test could not be used in trial. So I naturally question why I have a trial anyways, but none the less i'm wondering if a lawyer would be beneficial to me.

I don't understand why the first test was
illegal. Was it because the level is simply impossible? Well, even if you blew a .46 and that is admissable (see this is evanescent evidence, your level dissipates with time and eventually would go to zero)

You will have a trial anyway because you still blew a very high level when you brought in to the station, minutes later. So........ get a good criminal defense attorney to see what can be done.

But as many people on this board say: stupid is as stupid does. Why should someone get off a hefty sentence/fine for drunk driving? who cares if it was your 21st? Do you understand you could have killed someone?

YEah I'm a *******. Actually it was a .063 nd a .046 If it was as high as I explained I dont think I would be in a position to research my case the day after.
