What is the name of your state (only U.S. law)? California

Do sick leave hours count toward overtime?

For example, an employee worked 6 hours today. And she has also taken 3 hours for sick leave during the day. Does the employer have to pay her 1 hour of overtime?

Thank you. Just want to make sure. Does this rule apply to California?

Yes, it does.

It applies in all 50 states. No state requires overtime to be calculated on the basis of hours paid. Not even California.
