I was wondering baout getting my daughters father to sign away his parental rights to her. I am in Virginia .. He and i were never married .. heis NOT on her birth certificate and she does not carry his last name. He has however off and on paid child support for her ony when he has been found and his wages garnished. He ahs not seen her or had any contact with her since she was 2 weeks old and she is now yrs old. I have asked him to sign away his rights to her and he refuses. The only thing linking him to her as her father is a blood test that was taken. My question is do i even need his permission or anything to have his parental rights taken away from him. As i am getting married next year and my soon to be husband wants to adopt my daughter. Please any information on this would be appreciated Thank you in advance.Timber

My response:

Parental Rights cannot be "taken away" by the court, or voluntarily given up, unless there are certain circumstances that warrant such actions. Since, from a reading of your post, you haven't mentioned anything that would warrant such actions, your ex-boyfriend will remain in your child's life.
