What is the name of your state (only U.S. law)?pa my ex was beat up in a bar and has been getting excused medically from child support now for about a year and a half. he has a wage attachment since he has been guilty of contempt several times. he is telling me that he is suing the bar he was beat up in. he is also trying to get disability. my question is, if he wins any money through a lawsuit, will the money be intercepted automatically for child support? i am afraid he will get away with winning money and not paying me. he now owes me $17,000 in child support and it is accumulating.

For what is the money he is suing? That matters. Is it for medical bills, pain and suffering, loss of work? Also is this ex the father of your son with a broken arm? If so, does he have joint legal custody?
The money will not necessarily be intercepted automatically for child support.

If he qualifies for SSDI your child will receive separate benefits of his/her own. The CSE may be able to attach a lawsuit settlement (but may not also since it would apparently be a personal injury suit). However the CSE would have to know about the lawsuit.

yes it is the father of my son with the broken arm. he is suing for medical bills, pain and suffering, and loss of work. he does not have joint legal custody. i have full legal custody due to his problems with alcohol. is there any way i can find out if he has received money other money that is paying his medical bills? he is suing the bar because nobody helped him or called the police. he has been a total deadbeat, I say this because he basically abandoned my 2 kids.

Is the state enforcing your child support order?

If so, it is possible (no promises here) that some of that money could be intercepted for child support. Realize that if any award is made, it will first pay the lawyer(s) for your ex, then medical bills, THEN possibly any outstanding child support debt. Your case worker will know the correct steps to take to make a claim against any possible award.

You will need to help the CSED get the appropriate info--name of bar, any/all lawyers involved and contact info to give to your caseworker.
