What is the name of your state?What is the name of your state?I live in northern michigan. My son backed into another vehicle in january and both he and the other party had agreed they were to split the cost of the damges to the other car. The other party obviously felt they were partially at fault since they were improperly stopped in front of the driveway blocking it when his vehicle slid on some ice and contacted her vehicle. She then came up with an estimate of 200 which he thought was reasonable and agreed to pay his half. He then did not hear from her for over a month and she then said she wanted $900 (for him to pay the entire amt) for the damages as she got another estimate from a dealer. He declined to pay since it was contrary to their first verbal agreement, and the car was barely worth $900. She filed a small claim affidavit for $900 against him. The damage was more in line with $200 than $900My questions:

He is a minor, 17 and I believe he cannot even be sued legally in small claims court since he is under age 18. What should I do?
If we do proceed to court, if the judge determines it was 50-50 fault, is he obligated to pay at all under the no-fault rules in mich if both were only covered by PLPD?

Mini tort

In Michigan they have what is called a mini tort law Go to the web site www.mi.gov and look up mini tort .. I don't think they can sue for more that 500 plus court costs?? :cool: And if it was 50/50 Not sure if the court costs are split??? How did it come out if you had gone to court already??

Isnt MI a no fault state or is it just medical? Used to be in the 80s.
