I am left out of this first trust because I walked away from all the drama when my kids (now raised) stated to notice. In 2016 my older brother, younger brother and Dad decided they couldn't care of her and placed her in an assisted living situations.
Since the drama was greatly reduced I returned for a relationship with my Dad around 6-7 years ago. I get along good with my younger brother and support him as executor. He has documented every cents of costs, from the paid property taxes to bird seed. Each brother was given $50k, 40 acres and one got my grandparents home, on got two rentals. These were appraised and distributed with equality in mind. Addionally each grandchild $10k. To this point i was given nothing but when Dad saw I wasn't there for anything except a relationship with him he wanted to make my gifts equal with the boys distributions. So he offered me the house. I told him I hadn't done my share and that it should go to my executor brother because he had born most of the duties of care for my parents. When my husband got cancer Dad offered us even $50k to help. And later the content of his home and barn making the legal change to the trust to do so. In 2023 he pulled back the lady bird deal splitting the home between brother because older brothers care of gmas house and the 40 acre tree farm dad planted and having brother tell him that dad and his friends were not to step foot on. He left it to execute son and I agreed.
We had caretakers for Dad M-F 8am to 3. And eight to noon on S/S. It was recommended that we install cameras to keep and eye on him as Dad had a bucket list he wanted to complete and whether it was climbing on ladders or running a chain saw, he felt like a young man inside didn't want his freedoms restrained.
Then Dad past in Jan '24. Before he was in the ground the older brother tried to get into the house, take jewelry off Dad hand and neck while in the casket. We have camera confession the older brother stole Dads guns, witness that he tried to take Moms kwepie doll and nesting doll collection. Since my dad death we have had witnesses come forward to confess they saw physical abuse.
By Feb '24 older brother has filled a suit against my younger executor brother and my mom drawing her money down to the point ouf her no longer able to pay for her care.
Older brother bullies to get what he wants and younger brother and I say enough. We've been fight for a year to take care of mom as dad requested and mom just tells everyone she wants to go home. Which for reasons of money, illness and being a grade a B. Will stay where she is at. It would mean $300k a year for 24/7 care, that doesn't count he living expenses at the house (taxes, ultilites, groceries, medical and upkeep) my sis n law or myself are on disability for physical reasons and can not take care of her.
