SO STRESSED over THIS!!!!!! <statutory rape>

My best friend was 21 years old when he got his girlfriend pregnet she was 17, and they broke up and she eventually had there daughter. Well he has wanted be part of his daughters life (she's 8 months old) but she only lets him see her on her conditions and that's only when she's not out parting or whatever, she leaves his daughter at her fathers house. my friend is scared go through the courts to get some kind of custody of his daughter, he thinks they will charge him with somthing and he'll never be able to see his daughter. he basically lives in fear. does any one know what to tell him or what the max he could get charged ?
