What is the name of your state (only U.S. law)? Florida

I have applied for Social Security as a retiree and have not received my first payment. My husband died in 2016, however we were separated for years prior to his passing. He filed for disability before he passed and SSA overpaid him. They found their error many months later and asked for the money back. He was living off of it and could not repay it. He then went back to work to repay it and passed away shortly after.

Today, I have gotten a letter stating that they are withholding my Social Security payments until 2020, so they can recoup my deceased husband's money.
How is this possible? We had filed separated in our taxes once we were separated. We just never got the divorce.

I'm very upset and I do not know what to do. Should I hire a lawyer?

Filing separately doesn't mean anything by itself. If you were living together when he was overpaid, they indeed can come after you for the money.
