Someone is selling my patented product

I have finally achieved success in obtaining my Patent despite all the issues with the Patent and Trademark Intstitue of America. Unfortunatly, I see someone selling my product right now. After all I have been through with PTI, how do I find out how this seller obtained the design and stop them from selling my design?

What is the "Patent and Trademark Institute of America?" Are you referring to the U.S. Patent and Trademark Office, or is this some service or company you used to hep obtain a patent?

If you have an issued patent from the USPTO, and you believe someone is infringing your patent, your best bet is to contact a local patent attorney who can review all of the relevant facts in your situation, and advise you accordingly.

You could also contact the alleged infringer, and let them know that you have a patent and you feel that there are some similarities between your patent and their product. There are some things to consider when writing such a letter, so it may be worthwhile to get an attorney involved.

How they obtained the design? They looked at the patent. That's the whole point of the patent. In exchange for PUBLIC DISCLOSURE of your invention you get exclusive rights to it for a short period.

PTIA is a rip off joint that advertises as "Inventers Helpline" and a few other things on late night TV and elsewhere. They continually solicit money for you to do things that you could do your self. They certainly do NOTHING of the sort of thing that a real patent attorney would do for you.

If you do have a patent grant, then do what DGC says (and what you should have initially done)...find a patent attorney.
