What is the name of your state?NY, My x is getting cash payments from social services, about $200 per month, he lives with his mother and her social security takes care of all the house bills and they both get food stamps. X has been trying for about 1 1/2 yrs to get SSD and the doctors won't back him, they believe there is something he can do but he flat out refuses to get a job. Long detailed story that I won't get into. What I would like to know is if he is getting money from SS, after his credit on his child support payment account runs out will they make his CS payment out of the money they give to him every month? I have never heard of this and was wondering if anyone has.

It sounds like he has a Credit on CS .

NY has a Law for CS with Little or NO income , a minimum of $25.00 per Mo. must be paid ( this all depends on if there are no issues ).

If he were to receive SSDI , the Child(ren) would be entitled to a benefit as well , in the care givers name . ( most likely wiping out any cash CS obligations ).

If he were to receive SSI only , then the minimum would still be $25.00 per mo.
