Just had to respond to some posts. Didn't think it would hurt. Because I have a child of my own and step children I always try to put myself in mom's shoes....It would KILL me to think of another woman trying to mother my children. My son's father passed away a few years ago, so my hubby and i don't have to deal with my issues anymore. This leads me to a question......

My hubby wants to adopt my child. Does anyone have any opinion on this at all. He is 14 years old. I have talked to him about it and we have discussed keeping his fathers last name in the mix IF the name changes at all. Don't forget from first post. We (me and hubby have been together for 6 years. Sons father passed away 5 years ago. Just curious. We have not really seriously started anything, just mentioned it. Son thinks it would be cool to have same last name as all the rest of us.....And b/c it's shorter for school. Haha.. out of the mouths of babes.....(not really a babe, but will always be mine:))

If your husband truly wants to do that, and your son truly wants it as well, then there is absolutely nothing wrong with doing that.
 
Has your son been receiving SSI monthly due to his father's death? If so, I have a question for the senior members as to how this might be affected by an adoption.

In circumstances where a stepfather adopts a child whose father is still alive, the father's parental rights must first be terminated...which includes the obligation to pay child support. If your husband adopts your son, would that give the SSA reason to terminate payment of any death benefits being paid to the child?

SSI is more of a benefit that Dad earned by working during his life. The child would still be eligible.

However, Son would lose a better status to apply for school loans and grants.

I see only positive associated with this adoption.

Social Security Survivor's benefits continue after adoption...so that's no problem. I researched that one thoroughly some years back.

I wanted to reply because I was in a 'somewhat' similiar situation with my husbands son soon after his mom passed away. I receved some very sound advice on this site with regards to my situation, as well as information regarding adoption, after which we began to seriously consider.

I adopted my stepson the week after his 15th birthday, approximately two years after his mom died. He and I in particular had become so close in the 10 years before her death, that making it 'final' (via adoption) was to all of us involved, the logical next step and as such, the process itself was a very smooth transition.

Does this appear to be something that both your husband and son equally would like to happen? I was wisely advised to consider the feelings of Jesse's mom's family as well, which was a point I hadn't considered, but was one I took to heart, and one which made things that much more (for lack of a better word.. sorry) simple.

In the end, it simply completed our family, and we continued life from there. It got a little chaotic at times, but it was a good chaos and we were together, the kids were being raised together and that was that.

Didn't mean to turn my reply into something you'd expect from fuzzykittencuddles.com (gag) and not FA, but hopefully you get the idea.
