One of two co-trustees lied to a beneficiary who was told he does not own stock in a coproration. He did this to oppress her and regegg on his repsonsibilities as a trustee under his father;s trust. Now that the mother has died, he is forming a new "Special Needs Trust" to control her interests in a rather large substantial estate. I believe when the SSA and the IRS find out she lied all these years about having these stocks she;s not supposed to have, thus obtained Medi-Cal and SSI, they willl make her pay back all that money. Since it was the trustee who lied (so he doesn't have to take care of the beneficiary) and the trust lawyer who drafted the trust to begin with failed to to due diligence, is there any recourse for the wrongdoing trustee who started this scam to begin with? It would be a shame for the handicapped SSI Medii-Cal beneficiary to pay all the epenalties without due recourse to seek damages from the lying trustee. Is there anything that can be done??
