speed bump

my seventy year old parents live on a (no outlet) private drive along with five other families. Their house is last and the second homeowner wants to install a speed bump into this dirt lane. My parents have complain to
the township and they have said they can't do anything because it's a private road. Speed bumps are ilegal in new jersey, how about private roads? Who will inspect this speed bump for the collect height and width, so it doesn't put a hole in their oil pan or muffler. thanks

My response:

The magic phrase here is: "private road." Vehicle codes and Street Maintenance codes don't apply in private property situations. However, if there's damage to a car, the person who erected the speed bump will be responsible for negligence IF that person doesn't follow proper engineering specifications. So, drive slowly (which is the purpose of a speed bump).

Also, there's the question of who owns this private road? Does everyone who lives adjacent to the road, own the road? If so, is there anything in the Grant Deeds about usage and maintenance of this "easement"? For example, can one of the owners take it upon himself to do something to the roadway surface without permission from the other owners?

where do (we/he)get the proper enineering specification? Again, who will inspect his speed bump since a permit wasn't issued? who do we complain to about not asking them (parents) for their permission to install this speed bump? Does everyone beyond that point have to be notified by certified mail? Is a telephone pole lying in a trench ok for a speed bump. thanks
