I just got a ticket in Hampden, MA for $165 for 49 in a 30mph zone. It was a posted zone (changed just as I was pulled over) but the point is that the police officer followed me for 4/10 of a mile and wrote the speed was estimated? and clocked. I was wondering outside of calibration records and certification of use for the radar gun could that be considered entrapment by following me and "estimating"?

My response:

Simple answer: "No." Assuming, of course, that the cop's speedometer was so whacked out, that it read, for example 70 mph, when in fact his car was only moving at 30 mph. That scenario is extremely unlikely, wouldn't you agree?

Entrapment is a governmental entity or employee (a cop, etc.) causing or suggesting, to an otherwise law-abiding citizen, to do an illegal act that the citizen would not have otherwise committed "but for" the government's own acts, interference, or suggestions, to "cause" the law to be violated by the citizen.

Therefore, if you speed, you are breaking the law of your own volition and choice. It's your foot on the accellerator, not the cop's. Nice try, but no cigar.
